The Survivor's Trust

The Disclaimer Trust

During lifetime: Net Income & Principal to Surviving Settlor (HEMS)

During lifetime: All Net Income quarterly; Principal per HEMS to Surviving Settlor

Key Alerts & Action Items

The Material Information sections of the Snapshot flag specific legal provisions, risk areas, and missing elements. The following are the most significant flags from this demo case:

⚠  Key Alerts & Action Items from This Snapshot

Unsigned Documents: Henry's Will and The Price Family Trust are both unsigned and undated. These documents are not legally effective until executed. Priority action: schedule signing.

Blank Healthcare Directive: The Advance Healthcare Directive and HIPAA Authorization for both Henry and Mary are blank, unsigned, and undated. These must be completed before a medical event occurs.

Unsigned Trust: The Price Family Trust is unsigned and undated. All assets titled to the Trust and the entire distribution plan depend on the Trust being properly executed.

Document Age — POA & HCD: Henry's POA and Healthcare Documents are dated 2/2/02 — over 20 years old. Oregon law and personal circumstances may have changed. Review is recommended.

Successor Agent — Healthcare: Both Henry and Mary name 'Johnny Do Good' as successor healthcare agent. Confirm this person is still willing and able to serve, and that contact information is current.

How to Use This Report in Client Meetings

Start with Document Status.

Check which documents are signed and dated. Unsigned or undated documents need to be flagged immediately. In this case, Henry's Will and the joint Trust are both unsigned.

Review the Family Tree to confirm all relationships.

Ask: 'Is everyone still in the right place? Has anything changed with children, grandchildren, or family members?' This identifies outdated beneficiaries and new family members who may need to be included.

Walk through Fiduciaries to confirm roles are still appropriate.

Confirm executors, trustees, POA agents, and healthcare agents are still willing and able to serve. Note: both Henry and Mary share the same successor healthcare agent (Johnny Do Good), which should be verified.

Use the Overview Flowchart as the conversation anchor.

Many clients have never seen their estate visualised this way. Walk through how both Wills pour into The Price Family Trust, and how it then splits into the Survivor's Trust and Disclaimer Trust on first death. This is often the moment clients realise the documents haven't been updated in years.

Highlight the Material Information flags.

The Material Information pages are the most action-oriented part of the Snapshot. Each numbered point corresponds to a specific provision in the document, with page and article references. Use these to guide the attorney review conversation.
